Acceptance
By using bythemiledigital.com or engaging By The Mile Digital ("we", "us", "the agency") for services, you agree to these terms. If you do not agree, please do not use the site or our services. Specific engagements are governed by a separate written agreement that takes precedence over this page when they conflict.

Use of the website
The content on this website is for informational purposes. You may read, share, and reference articles with attribution. You may not copy substantial sections to republish under another name, scrape the site for resale, or attempt to disrupt its operation.
The contact form and direct contact channels are for genuine inquiries. Sending unsolicited sales pitches, spam, or automated submissions may result in your IP being blocked.
Services
We provide search engine optimization (SEO), Google Ads management, and website design and development services. The specific scope, deliverables, and timeline of any engagement are documented in a separate proposal or service agreement signed by both parties.
- SEO retainers are month-to-month with no long-term contract. Either party may end the engagement with 30 days' notice.
- Website builds are flat-fee, with a deposit at signing and the balance due at launch.
- Google Ads management includes campaign setup and ongoing management. Ad spend is billed directly by Google to the client account.
Payment terms
Invoices are due on the date stated on the invoice (typically Net 7 or Net 15 depending on the engagement). Late payments may pause delivery until the account is current. We do not charge late fees unless an invoice goes more than 30 days unpaid, at which point a 1.5 percent monthly fee may apply. Payment methods, currencies, and processors are listed on each invoice.
Intellectual property
You own the content you provide and the final deliverables paid for in full (your website, the content we wrote for you, the optimization work delivered). We retain rights to the underlying processes, frameworks, internal tooling, and any pre-existing components used to build deliverables. We may showcase the work in our portfolio and case studies unless you ask us not to in writing.
No guarantees on rankings
SEO and digital marketing involve search engines, ad platforms, and competitor activity that we do not control. We do not guarantee specific rankings, click volumes, lead counts, or revenue outcomes. We do commit to honest work, full transparency on what we ship each month, and receipts for every off-page dollar spent on your behalf.
Limitation of liability
To the extent permitted by law, our total liability for any claim arising from a service engagement is limited to the fees you paid us in the three months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or business opportunities. Nothing in these terms limits liability for fraud, willful misconduct, or any liability that cannot be excluded under applicable law.
Termination
You may end an engagement at any time per the notice period in your specific agreement (typically 30 days for retainers). We may end an engagement if a payment is more than 30 days overdue, if the work cannot be performed for reasons outside our control, or if either party materially breaches the agreement. On termination, we deliver in-progress work, hand over credentials and assets, and issue a final invoice for completed work.
Changes to these terms
We may update these terms when our practices change. The "Last updated" date at the top of this page reflects the most recent revision. Material changes will be communicated to active clients directly.
Governing law
These terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-law principles. Disputes that cannot be resolved through good-faith discussion will be handled in courts located in Georgia, unless the engagement agreement specifies otherwise.
